Every Crux Club, LLC event (hereinafter “Activity”) participant must read, understand and agree to this legally binding Waiver of Liability and Non-Disclosure Agreement in order to participate in Activity. By signing this agreement, you, the UNDERSIGNED (hereinafter “Participant”), give up your right to bring a court action to recover compensation or obtain any other remedy for any injury to you or to your property or for your death however caused arising out of your participation in the Activity.

NON-DISCLOSURE.

Participant agrees to not post photos of game props nor divulge any story content on social media or anywhere else. Crux Club, LLC reserves the right to refuse entry to any Activity if the employees or staff believes that participants could create a risk of harm to themselves or other participants.

USE OF MEDIA.

Crux Club, LLC may record Participant and use Participant’s name, face, likeness, voice and appearance in connection with exhibitions, publicity, advertising, and promotional materials without reservation or limitation.

ASSUMPTION OF RISK.

Participant is fully responsible and held liable for their own safety. Participant agrees to voluntarily participate in the Activity which may involve risk of serious injury, including mental stress and anxiety, arduous physical activity, lack of first aid stations, permanent disability and death, property loss and severe social and economic losses. These risks include, but are not limited to, those caused by: the actions, inactions or negligence of the Released Persons, spectators, event officials, and organizers; conditions of the premises or equipment used; rules of play; temperature; weather; condition of participants; and, vehicular or pedestrian traffic. Participant understands their personal physical limitations and is sufficiently self-aware to stop physical activity before the possibility of becoming ill or injured. The Participant also acknowledges and understands there may be also be other risks that are not known or foreseeable at this time. Released Persons cannot guarantee the Participant’s personal health or safety during the Activity or any other time. Participant knowingly and voluntarily assumes all such risks, both known and unknown, anticipated and unanticipated, even if arising from the negligence of the Released Persons or others, and the Participant assumes full responsibility and liability for the Participant’s participation. Participant agrees to obey all traffic laws, federal, state and local laws and regulations, and is physically and mentally fit to participate in Activity. Participant agrees to obey the rules of any establishment they enter or use during the Activity, and that they are not under the influence of drugs or alcohol which may impair their ability to maintain their safety awareness or endangers others. 

 

RELEASED PERSONS: Crux Club, LLC and its affiliates, officers, directors, agents, owners, employees, designers, licensors, and members, as well as the property owner and tenants of the properties and locations visited harmless from any and all claims or causes of action arising out of Participants participation in Activity; other participants, sponsoring agencies, sponsors, and advertisers and their agents, officers, directors, officials and employees.

 

RELEASE OF ALL CLAIMS AND COVENANT NOT TO SUE.

Participant made a voluntary and informed decision to release any future lawsuits or claims that they may have against the Released Persons. Therefore, Participant agrees to expressly release and forever discharge Released Persons from any and all liability, claims, demands or causes of action whatsoever arising out of any damage, loss, personal injury, or death arising from participation in Activity.

 

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY AND A WAIVER OF ANY RIGHT THAT PARTICIPANT MAY HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST CRUX CLUB, LLC. SHOULD ANY CLAIM BE MADE, I UNDERSTAND AND AGREE THAT I WILL BE RESPONSIBLE FOR ALL ATTORNEY’S FEES AND DEFENSE COSTS INCURRED BY CRUX CLUB, LLC IN CONNECTION WITH OR IN THE DEFENSE OF THAT CLAIM. This Release and Waiver is made in accordance with C.R.S. § 13‐22‐107. This agreement specifically contains an indemnity agreement whereby I agree to reimburse the Released Persons against any damages (including attorney’s fees and costs) incurred as a result of any lawsuit, claim, or action brought by Participant.  Participant understands that no person has permission to participate in Activity without an effective and validly signed Release and Waiver of Liability. Participant understands that by signing this Release they are voluntarily giving up their right to bring a lawsuit or claim against the Released Persons. Participant has read the above, considered its effects, understand its content, and agree the terms as stated above and is signing of their own free will without any inducement.
